24. Intellectual Property

The “KISS MY BAG” logo is a registered trademark, no. 2443189. The material found on the Website is copyright KMB unless otherwise stated. Nothing on the Website grants You the right to use the “KISS MY BAG” logo or any of the copyright material found on the Website, including but not limited to the layout of the site, these terms and conditions, Guest and Member contributions, buttons, scripts and graphics.

KMB respects the intellectual property rights of third parties, and makes no claim to third party intellectual property that may appear on the Website from time to time. Any material that KMB suspects to be in infringement of a third party’s intellectual property will be removed from the Website as soon as KMB becomes aware of said material.

25. Governing Law

KMB, the Service, the Website and these terms and conditions in all respects fall under the exclusive jurisdiction of the laws of England and Wales. Any disputes arising from or in relation to the Service, the Website, these terms and conditions and anything connected to KMB shall be settled before the courts of England and Wales.

26. Assignment

You may not assign or transfer any of Your rights or obligations under this contract without the prior written consent of KMB. KMB reserves the right to assign or transfer any or all of its rights under  this contract in which event it shall be sufficient for KMB to give notice to You of the assignment.

27. Tax

You agree to be responsible for all tax liabilities arising from the use of the Service.

28. Restatement of Acceptance

You understand that this contract is personal to You and as such the Products must be used by You ONLY. If You do allow third parties access to and or use of the Products You shall remain absolutely liable for such Products under the terms and conditions of this contract.

Having carefully read through these terms and conditions, Your continued use of the Service and/or Website evinces Your acceptance to these terms and conditions. You hereby agree to use the Service and/or Website in accordance with the provisions of these terms and conditions. You further declare that you are aware of the penalties for the late return of a rented Product, the costs and conditions for replacing a Product and the onus on You to ensure receipt of the item as set out in these terms and conditions, and that You accept these risks and liabilities.

ANNEX A

“Rental Period”

The Rental Periods under this contract are:

·          two (2) Days;

·          seven (7) Days;

·          fourteen (14) Days; or

·         twenty eight (28) Days;

All Rental Periods begin on the day the Product is delivered to You by the Carrier and end on the day before the Product is passed by You to the Carrier for return to KMB.

ANNEX B

“Delivery Fee”

The following Delivery Fee will be charged for delivery of Products by Your choice of Carrier as set out below:

Royal Mail Special Delivery for a Delivery Fee of £10; or

By a recognised courier (e.g. UPS, Fedex)  for a Delivery Fee of £18

ANNEX C

“Product Replacement Fees”

The following Product Replacement fees are applicable and will be charged for theft, loss, damage or excessive wear and tear of Products rented by You as set out below:

“Excessive wear and tear” shall be decided at the sole discretion of KMB. KMB reserves the right to modify these product replacement fees from time to time as necessary. You will be made aware of the currently applicable product replacement fee in Your order confirmation.
