11. Right to Cancel

You have the right to cancel a contract, excluding contracts for Product rental where the Rental Period has already begun, made between You and KMB up to seven (7) working days after its conclusion.  To do so, You must notify KMB of Your cancellation within this time period in writing by post to our registered offices, fax or by email. You will be entitled to a fund refund, excluding any postage charges incurred. 

12. Product Availability

When selecting Your Product, You will only be able to order that Product for rental if it is available for the entirety of the rental period. In the unlikely event that the Product becomes unavailable after Your order is confirmed, You will be contacted by KMB to arrange a suitable Product substitution or refund. 

13. Delivery & Return

Members can select to have Products delivered either by Royal Mail Special Delivery or by a courier (e.g. UPS, Fedex)  for a Delivery Fee as set out in Annex B. This Delivery Fee covers both the delivery of the Product, its return to KMB and transit insurance for the total value of the Product. KMB reserves the right to alter the Delivery Fee from time to time.  KMB will notify You of any changes in the Delivery Fee prior to Product delivery and You will be entitled to cancel Your order should You refuse the Delivery Fee change. 

Delivery times are dependant on, amongst other things, stock availability, the delivery address and the time and date when You place an order. KMB will try to ensure that the Product reaches You within three (3) working days of You placing the order, although KMB makes no guarantee as to the delivery time. Once the Product has been passed to the Carrier You will be notified by email of an estimated delivery date.  KMB makes no guarantee as to the accuracy of this estimate.

You will be supplied with a return address label and information on how to return the Product through Your selected Carrier with the Product. Please return the Product in its original packaging and ensure that the packaging has been securely fastened.

You must return all Products rented from KMB by the return date notified to You. Failure to do so may result in KMB charging You for an additional Rental Period or the full replacement cost of the Product.

14. Territory

KMB will only dispatch Products to addresses in the United Kingdom and Ireland. All Products rented to You by KMB must remain in the United Kingdom and Ireland for the duration of the Rental Period.

15. Product replacement fees

Each Product is given a price, based on the cost of replacement of the Product. These are outlined for each Product in Annex C. These prices indicate the estimated replacement fee for a Product where that Product is damaged beyond normal wear and tear, stolen or lost. You agree to be liable for the cost of replacing a Product as set out in Annex C that You have rented where that Product is damaged beyond normal wear and tear, stolen or lost..

Website

16. General

The KMB Website is made available to You on a personal and domestic basis, and is subject to these terms and conditions. You are hereby granted to a limited licence to access and enjoy the Website for these purposes.

The material on the Website is protected by copyright. You may not use the material in any way which would infringe the intellectual property rights of KMB, such as copying, modifying or distributing the material found therein. This is without prejudice to the right to make incidental copies of the Website for technical purposes, i.e. caching.

You may not use the Website to obtain a list of KMB’s Guests and Members for commercial purposes or in any way alter the appearance of the Website by placing material within or over the Website’s pages.

17. Access

KMB reserves the right to limit Your access to the Website in order to update or maintain the Website. Where this is necessary, KMB will endeavour to reinstate access as soon as possible.

18. Guest & Member Contributions

KMB encourages its Guests and Members to contribute positively to the Website.

In contributing to the Website, by for example submitting a Product review or commenting on the Service, You grant KMB an automatic, non-exclusive, perpetual, worldwide and assignable licence without any fee or other consideration either at the time the contribution is made or in the future, which allows KMB to use either part or the whole of the contribution in any way KMB so wishes, including but not limited to use in any media form and for advertising purposes. 

KMB reserves the right to remove any contributions from the Website without notice.

19. Restrictions on Contributions

In contributing to the Website, You shall not make information available on the Website:

(i)           From which an individual can be identified, including but not limited to names, telephone numbers (fixed and mobile), email and postal addresses;

(ii)          Which may be harmful to minors;

(iii)        Which may be prejudice to third party rights;

(iv)        Which may infringe the intellectual property rights of KMB or a third party;

(v)         That contains a computer virus or other malicious code;

(vi)        That consists of “spam” or “junk” messages, or any other kind of solicitation;

(vii)      That promotes a commercial interest other than that of KMB;

(viii)     That is potentially defamatory to KMB or a third party;

(ix)         That is in any other way unlawful, obscene, vulgar, prejudice towards a minority, inciting or in contrary to the Law of England and Wales.

If You post any material which KMB considers to be in breach of this clause, or any other clause contained in these terms and conditions or the privacy policy, then KMB reserves the right to immediately suspend Your registration with KMB.

20. Termination of Guest Registration

KMB may, at its discretion, suspend or terminate Your Guest registration with KMB, and remove any contributions You have made to the site, for any reason, including but not limited to non-use, violation of the terms and conditions or privacy policy or failing to act within the spirit of the terms and conditions or privacy policy.

KMB shall not be held liable to You if it suspends or terminates Your Guest registration with KMB.
