1. Definitions

The expressions used herein are ascribed the following meanings:

“Carrier” means the third party delivery service selected by Guests and Members from either Royal Mail Special Delivery or a recognized courier service in accordance with the terms of this contract.

“Day(s)” means calendar days, including weekends, unless otherwise specified as “working day(s)”, in which case this excludes Sunday and public holidays in the United Kingdom.

“Delivery Fee” means the fee set out in Annex B to this contract.

“Guest” means an individual who has successfully completed the registration process of the Website but who has not paid for a subscription.

“KMB” means Kiss My Bag Ltd, company number 06014064, whose registered office is at 30 Ashby Avenue, Chessington, Surrey, KT9 2BU. “Member” means an individual who has successfully completed the registration process of the Website and who has paid for a subscription with KMB.  “Membership” shall be construed accordingly.

“Products” mean handbags or other goods to be provided by KMB.

“Rental Period” means the periods set out in Annex A to this contract.

“Service” means the rental or purchase of Products from KMB.

“Subscription” means becoming a Member of KMB through agreeing to make a monthly payment to KMB.

“Website” means the website of KMB, www.kissmybag.com

“You” and “Your” mean the individual using the Website and/or Service provided by KMB.

2. Acceptance of these terms and conditions.

These terms and conditions constitute a binding contract between You and KMB. In these terms and conditions, words importing the masculine gender shall include the feminine gender and words in the singular shall include the plural and words in the plural shall include the singular. By using the Website or Service You hereby agree to these terms and conditions.

These terms and conditions are incorporated by reference in every binding contract between You and KMB, and govern the use of the KMB Website. If You do not agree to any or all of these terms and conditions, please do not use either the Service or Website.

3. Changes to these terms and conditions

KMB reserves the right to modify these terms and conditions from time to time. The modified terms and conditions will become effective from the time and date the modifications are placed on the Website along with notice of said modifications and shall only affect those contracts entered into between You and KMB from the date of such notice[A II1] . Use of the Website after this date shall indicate that You accept these modifications.

If You object to any modifications to these terms and conditions, or have any other consumer complaint, You must immediately notify KMB, by email ( This e-mail address is being protected from spam bots, you need JavaScript enabled to view it ) or in writing to the registered office. In such case, KMB requests that You do not continue to use either the Service or Website until the complaint is resolved.

 KMB shall not be liable to You for any modifications to these terms and conditions or any refusal to accept said modifications.

The Service

4. General

In order to take advantage of any KMB Service You must be registered with the Website. KMB offers two types of registration, known as “Guest” and “Member”.

Registration as a Guest is free and does not require You to submit any payment details. Nor does it require You to take advantage of any Service. Guests are entitled use the Website and submit content on the Guest Forum. Guests are not entitled to rent Products from KMB, but can purchase Products You are free to upgrade to Member status at any time by paying the monthly Subscription fee.

Registration as a Member is dependant on a successful registration as a Guest and the confirmed payment of the relevant Subscription fee as detailed in clause 6 below. Registration as a Member entitles You, amongst other things, to rent Products from KMB, the option to purchase a Product during Your Rental Period at a discount from the Product’s RRP, promotional offers, access to a Members forum and entry into competitions.

In order to register as either a Guest or a Member, You will be required to create a password. You are advised to keep this password strictly confidential. You are solely responsible for maintaining the confidentiality of this information, and You are solely responsible for any use or misuse of Your registration with KMB. You must contact KMB immediately if You suspect unauthorised use of Your registration with KMB. If KMB suspects misuse, KMB reserves the right to require You to select another password and/or suspend Membership and interrupt Service until further notice. 

5. Registration as a Guest

If You wish to register as a Guest, KMB requires:

(i)             That You are at least 18 years old;

(ii)           That You have the legal capacity to enter into contracts with KMB under the laws of England and Wales;

(iii)          That the information You provide is true, accurate and contains no omissions material to the contract or Service;

(iv)         That You agree to all the terms and conditions contained herein; and

(v)           That the application is in all respects acceptable to KMB at its sole discretion.

You will not be required to submit any payment details when registering as a Guest. You will only be asked for payment details when You decide to register as a Member and take advantage of a Service. As a Guest, Your delivery details will be stored on the website’s database if You decide to purchase a Product.
